Types of Visa: H, L, E, and So On

Here are some of the various employment visas:

  • The PERM Labor Certification replaces the existing labor certification after March 27, 2005. The Department of Labor's PERM approval will be given within 45-60 days in most cases. Once approved by the Department of Labor, the applicant can use simultaneous filing to obtain employment authorization for himself and his family 90 days after submitting the petitions for those applicants inside the U.S. Applicants outside of the U.S. have to wait for consular processing to enter the U.S. with permanent residency.   • If the applicant has a job offer from a private employer, he may apply for an H-1B on April 1, 2005 to qualify for the October 1, 2005 deadline. At any time, he may apply with a job offer from a university, college, non-profit, or the U.S. government. The H-1B visa allows three years of work in the U.S. and may be extended. To qualify, he needs a four-year university degree (or equivalent work experience).
  • If a foreign company opens a U.S. office, managerial employees with one year employment may enter with an L-1 visa (inter-company transfer).
  • U.S. investment treaties allow an E-1 or E-2 visa. The nature of the business and investment determines the visa.
  • The EB-1 visa is for persons with extraordinary ability in sciences, arts, education, business, or athletics which has been demonstrated by sustained national or international acclaim and whose achievements have been recognized in the field through extensive documentation. This visa grants lawful permanent residency without an offer of employment.
  • The EB-2 visa is for persons with advanced degrees (or equivalent) or who because of their exceptional ability in the sciences, arts, or business will substantially benefit the national economy, culture, educational interests, or welfare of the U.S. and whose services are sought by an employer in the U.S. A national interest waiver eliminates the need for an offer of employment. This visa grants lawful permanent residency.
  • The EB-3 visa is for professionals with a baccalaureate degree (or foreign university equivalent) or persons who are a member of the professions, skilled workers or other workers, including foreign nationals with less than two years of training and work experience. A job offer and labor certification is needed for all EB-3 visas. A national interest waiver is not available for EB-3. This visa grants lawful permanent residency.
  • The J-1 visa allows up to 18 months of work in the US for a trainee, teacher, professor, research scholar, specialist, international visitor, medical trainee, alien physician, short-term visitor, government visitor, camp counselor, or au pair. The employer applies for the J-1 visa. When the J-1 visa expires, the holder must return to his home country for two years unless a waiver is obtained.
  • The O visa is for persons of extraordinary ability in the science, arts, education, business, or athletics which has been demonstrated by sustained national or international acclaim. With an employment offer, the applicant may receive an O visa.
  • Students may receive employment authorization known as practical training if they have studied for at least nine consecutive months, the work it is related to the course of study, and it is not for English language training.
